8. The employer commits to:
- Directly employ [PAYE] the Apprentice and issue a contract of employment/statement of written employment particulars. The employment must commence before the apprenticeship start date.
- Have consulted with the Apprenticeship provider during the recruitment process on the suitability of the potential apprentice.
- Confirm the apprentice is normally and lawfully resident in the UK and has been for the last 3 years.
- Subject to the Apprentice meeting the requirements of their contract of employment/statement of written employment particulars, employ the Apprentice for at least the duration required to complete the apprenticeship.
- Employ the Apprentice for a minimum of 30 hours per week and 50% of this should be spent working in England over the duration of the apprenticeship.
- Pay the apprentice at least in accordance with the National Minimum Wage and issue payslips.
- Provide the Apprentice with the on-the-job training, mentoring and support required to achieve the milestones.
- Provide the Apprentice with the off-the-job training (workplace shadowing, mentoring, industry visits, workshops etc.) required to achieve the milestones.
- Provide the Apprentice with any personal protective clothing and safety equipment required for the Apprentice to carry out their day-to-day work.
- Release the Apprentice from their normal workplace duties to enable the apprentice to undertake off-the-job training. Release shall be for a minimum of 20% of normal working hours across the duration of the apprenticeship.
- Work collaboratively with the Apprentice and Main Provider, including coordination of on- and off-the job training and participation in and contribution to reviews of the Apprentice’s progress and achievement.
- When the apprentice achieves the apprenticeship, the apprentice should remain with the employer, where a job opportunity continues to exist and where an apprentice wishes to remain. Where this is not possible, the apprentice will be supported by the provider and employer to seek alternative opportunities.
